These Terms and Conditions outline how we will work together across coaching, facilitation, workshops, and transformational programs. They are designed to create clarity, shared expectations, and a strong foundation for meaningful outcomes.
By purchasing, enrolling, or participating in any Performastery service, you confirm that you have read, understood, and agree to these Terms.
2. Services & Scope
Performastery provides transformational leadership coaching, facilitation, workshops, and development programs tailored to individuals, teams, and organisations.
Each engagement is designed based on your context, goals, and needs. While we bring expertise, structure, and guidance, outcomes are influenced by your level of engagement, openness, and implementation.
Any requests outside the agreed scope may require a separate agreement or additional fees.
3. Client Responsibilities
To get the most from your engagement, you agree to:
• Actively participate in sessions and discussions
• Complete agreed actions between sessions
• Remain open to feedback, reflection, and new perspectives
• Take responsibility for your own decisions, actions, and results
• You are responsible for ensuring you attend sessions prepared, with appropriate technology, materials, and focus.
4. Sessions & Booking
4.1 Booking Responsibility
You are responsible for booking and attending all sessions within the agreed timeframe.
Sessions:
• Must be used within the allocated period
• Do not roll over
• Are non-transferable
• Are non-refundable unless required by law
4.2 Cancellations & Rescheduling
Minimum notice for rescheduling: 24–48 hours, unless otherwise agreed
Late cancellations may result in forfeited sessions
4.3 Late Attendance & No Shows
Sessions will end at the scheduled time, regardless of late arrival
Failure to attend may result in loss of the session
5. Communication
Communication will occur via agreed channels, which may include:
• Email
• Private client platforms or groups
• Scheduled calls or sessions
• Standard response times are typically within 48–72 business hours.
• For organisational engagements, a primary contact person will be nominated and will be responsible for internal communication.
6. Digital Platforms & Client Portal
Performastery may use digital platforms, including a client portal, website, and third-party tools. By using these, you agree that:
• You are responsible for maintaining the confidentiality of your login details
• You will not share access with unauthorised users
• You accept that occasional outages or technical issues may occur
• Performastery is not liable for disruptions caused by third-party platforms.
7. Payment Terms
All fees must be paid as agreed at the time of purchase or engagement.
For payment plans or subscriptions:
• Payments must be made on time
• Missed payments may result in suspended access to services
• Outstanding balances may be pursued
• Payment obligations remain regardless of attendance, participation, or completion.
8. Refund Policy
All purchases are final. Refunds, credits, or transfers are not provided, except where required under Australian Consumer Law.
9. Confidentiality
Both parties agree to maintain confidentiality of all shared information.
This includes:
• Personal insights
• Business strategies
• Group discussions
• Materials and resources
• Confidential information must not be disclosed without prior consent, unless required by law.

Both parties agree to maintain confidentiality of all shared information.

11. Program Access & Resources
You may receive access to:
• Session recordings
• Resources, templates, or tools
• Program materials
• It is your responsibility to:
• Download and retain materials where applicable
• Keep track of access timelines
• Access to materials may be time-limited.
12. Behaviour & Engagement Standards
All clients are expected to engage respectfully and professionally and abide by the program agreements as outlined in the program materials. Performastery reserves the right to suspend or terminate access without refund if behaviour is deemed inappropriate, disruptive, or harmful to others.
13. Limitation of Liability
Performastery provides guidance, support, and expertise, however:
• No specific results or outcomes are guaranteed
• Results depend on your actions, decisions, and circumstances
• To the maximum extent permitted by law, Performastery is not liable for any direct or indirect loss arising from participation in services.
14. Compliance with Australian Law
These Terms are governed by the laws of Australia, including Queensland where applicable. Nothing in these Terms excludes or limits your rights under the Australian Consumer Law.
15. Termination
Performastery reserves the right to terminate services if:
• Payments are not maintained
• Terms are breached
• Behaviour is inappropriate
• Clients may choose to discontinue services, however no refunds will be issued for unused portions unless required by law.
